SAMUEL, Judge.

Rayon Reigate, administrator of the estate of his brother, sued Laverne Torrance, employer of decedent, and her workman's compensation insurer, Travelers Insurance Company, seeking judgment against the defendants in solido for the death benefits owed by the employer to decedent. The employer and insurer answered denying liability, stating only "* * * that the decedent was an employee of plaintiff at the time of the accident; that plaintiff was not sued in his capacity as employer or employee; that plaintiff is not a proper party-plaintiff to this action; and that this is the first time that plaintiff has instituted any action against them." At the trial of the case Laverne Torrance admitted liability and judgment was rendered dismissing plaintiff's demands against her.

The sole issue presented is whether the administrator of the estate of his deceased brother is a proper party plaintiff. Plaintiff insists he is. Defendants argue he is not.

The Industrial Relations Division of the Department of Labor and Employment (LSA-R.S. 33:1401) administers claims for death benefits provided by workman's compensation laws. The legislative process in enacting R.S. 33:1401 was provided by C.P. Article 5232. Section 1 of that article reads:
